RESUMO
\nEste artigo examina os efeitos adversos da pandemia provocada pelo novo coronav\u00edrus (Sars-Cov-2) sobre os povos ind\u00edgenas brasileiros como decorr\u00eancia de uma pol\u00edtica discriminat\u00f3ria do Estado Brasileiro. Tomando como ponto de partida a experi\u00eancia hist\u00f3rica de viol\u00eancia e discrimina\u00e7\u00e3o enfrentada por povos ind\u00edgenas no Brasil, o artigo analisa a emerg\u00eancia da pandemia em n\u00edvel global, bem como seus desdobramentos no contexto nacional, salientando os impactos desproporcionais sobre os povos ind\u00edgenas, em especial das regi\u00f5es norte e centro-oeste brasileiras. Para isso, o artigo aponta as principais fontes de vulnerabilidade dos ind\u00edgenas e identifica uma s\u00e9rie de medidas adotadas ou omitidas pelo governo brasileiro em face dessas popula\u00e7\u00f5es no contexto da pandemia. Em seguida, o artigo analisa o referencial te\u00f3rico e jur\u00eddico do direito da antidiscrimina\u00e7\u00e3o a fim de verificar se e em que medida as pol\u00edticas estatais adotadas com rela\u00e7\u00e3o a esses povos violam o mandamento da igualdade \u00e9tnico-racial e a Conven\u00e7\u00e3o Internacional para a Elimina\u00e7\u00e3o de todas as formas de Discrimina\u00e7\u00e3o Racial. Considera-se de modo simult\u00e2neo a prote\u00e7\u00e3o antidiscriminat\u00f3ria conferida, em perspectiva universal, a indiv\u00edduos ind\u00edgenas, como tamb\u00e9m a prote\u00e7\u00e3o espec\u00edfica dirigida a grupos minorit\u00e1rios. A pesquisa parte, portanto, de um problema concreto e atual apresentado como resultado de investiga\u00e7\u00e3o bibliogr\u00e1fica e documental e se dirige \u00e0 an\u00e1lise te\u00f3rica e legal de seu enquadramento como discrimina\u00e7\u00e3o \u00e9tnico-racial praticada pelo Estado Brasileiro.<\/p>\n
ABSTRACT
\nThis article examines the adverse effects of the pandemic caused by the new coronavirus (Sars-Cov-2) on the Brazilian indigenous peoples as a consequence of a discriminatory policy undertaken by the Brazilian State. Drawing from the historical experience of violence and discrimination endured by indigenous peoples in Brazil, this article analyzes the global rise of the pandemic followed by the developments in the national context, highlighting the disproportionate impacts on indigenous peoples, especially in northern and central-western regions. The article points out the main sources of vulnerability of indigenous people and identifies a series of measures adopted or omitted by the Brazilian government towards these populations in the context of the pandemic Then, the article analyzes the right of anti-discrimination in order to verify whether and to what extent the state policies adopted in relation to these peoples violate the commandment of ethnic-racial equality and the International Convention for the Elimination of all forms of Racial Discrimination. The anti-discrimination protection afforded, in a universal perspective, as well as the specific protection addressed to minority groups are simultaneously taken into account in this analysis.
